McGraw's Lawsuit Tossed Out

A judge dismissed allegations that West Virginia Media and a Charleston lawyer had libeled the former Supreme Court justice.

A judge on Monday threw out a lawsuit filed by former state Supreme Court Justice Warren McGraw over ads that targeted him prior to last year's general election.

Taylor County Circuit Judge Alan D. Moats dismissed McGraw's suit against Charleston attorney George Carenbauer and West Virginia Media Holdings.

The suit claimed ads that ran on West Virginia Media station WOWK-TV were untrue. Carenbauer was the lawyer for the group And for the Sake of the Kids, which paid for the ads.

Massey Energy CEO Don Blankenship is named in the suit; he provided most of the money the group raised to run the ads. Moats' order did not dismiss the suit against Blankenship.

Republican Brent Benjamin defeated McGraw in the Nov. 2 general election.
