His decision will change process for the U.S. Army Corps of Engineers.
BECKLEY -- U.S. District Court Judge Joseph Goodwin says the U.S. Army Corps of Engineers' national permitting process for valley fills is in violation of the Clean Water Act.
The decision means the Corps will not be able to issue new valley fill permits without changing the process to consider environmental impact and allow for public input on each permit application.
The decision comes after a lawsuit filed by the Ohio Valley Environmental Coalition, Coal River Mountain Watch and the Natural Resources Defense Council.
In his written decision, Judge Goodwin said 200 miles of streams in West Virginia have already been lost to valley fill practices.
