Anyone charged with underage drinking or using a fake ID to get alcohol might be able to avoid jail time, under a new bill moving through the Legislature.
The Senate passed Senate Bill 409 on Feb. 13. That bill would allow anyone charged with possession, sale or consumption of alcohol, along with anyone who uses a fake ID to obtain alcohol, to serve community service rather than jail time.
The current law is a penalty of a $500 fine and/or 72 hours in jail. This bill would swap out community service for jail time.
The measure now goes to the House of Delegates for debate.
